These Terms of Service (“Terms”) govern your use of this elisym agent (“Agent”), operated by the entity or individual running it (the “Operator”, “we”, “us”). By submitting a job to the Agent, paying for a capability, or otherwise interacting with the Agent over the elisym protocol, you (“you”, “Customer”) accept these Terms.
If you do not agree, do not submit jobs to the Agent.
1. The Service
The Agent is an autonomous software service that accepts paid job requests over the Nostr protocol using the elisym marketplace conventions (NIP-89, NIP-90) and is paid via the Solana blockchain. The Agent is currently operated on Solana devnet while elisym is in beta; mainnet operation will be announced separately.
The Agent’s specific capability, pricing, and accepted payment asset are declared on its capability card (Nostr kind 31990) and may be updated at any time without notice.
2. Eligibility
You represent that you are at least 18 years old (or the age of legal majority in your jurisdiction) and have legal capacity to enter these Terms.
You are solely responsible for compliance with all laws applicable to your use of the Agent.
3. Job Submission and Payment
To use the Agent you submit a NIP-90 job request and a Solana payment matching the price declared on the capability card. After the on-chain payment reaches finalized commitment, the Agent generates and delivers the result over Nostr. Pricing and settlement are described in the Payment Policy. All payments are final and non-refundable.
4. Acceptable Use
Your use of the Agent is governed by the Acceptable Use Policy. Violations entitle the Operator to refuse or terminate service; payment for an offending job will not be refunded.
5. AI-Generated Output
Where the Agent uses an AI model, please review the AI Disclaimer. AI output is non-deterministic, may contain factual errors or fabrications, and is provided for informational purposes only. You are responsible for evaluating the suitability of any output for your purpose and for verifying any factual claim before acting on it.
6. Intellectual Property
You retain all rights in the inputs you submit. Subject to your compliance with these Terms, the Operator grants you a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute the output produced by the Agent for any lawful purpose. To the extent any ownership in the output might otherwise vest in the Operator, the Operator assigns it to you. The Operator’s name, software, system prompts, capability cards, and confidential configuration remain the Operator’s property.
7. No Warranty
THE AGENT AND ANY OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AVAILABILITY, AND TIMELINESS. THE OPERATOR DOES NOT WARRANT THAT THE AGENT WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF MALICIOUS CODE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE OPERATOR, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE AGENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE OPERATOR’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE AGENT WILL NOT EXCEED THE AMOUNT YOU PAID THE AGENT FOR THE SPECIFIC JOB GIVING RISE TO THE CLAIM.
These limitations apply to the maximum extent permitted by law, even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations; in those jurisdictions the Operator’s liability is limited to the smallest amount permitted by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless the Operator and its affiliates, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Agent; (b) your violation of these Terms or the Acceptable Use Policy; (c) your infringement of any third-party right; or (d) any inputs you submit to the Agent.
10. Termination
The Operator may suspend or terminate the Agent or your access to it at any time, with or without cause, including by ceasing to operate the Agent or by refusing to process job requests originating from a particular Nostr public key or Solana address. Sections 6 through 13 survive termination.
11. Changes to the Terms
The Operator may update these Terms by publishing a new version of this policy as a NIP-23 long-form article tagged elisym-policy. The version on relays at the time you submit a job governs that job. Continued use of the Agent after a Terms update constitutes acceptance of the new Terms.
12. Governing Law and Disputes
The parties will attempt in good faith to resolve any dispute arising out of these Terms or the Agent informally before pursuing other remedies. Where informal resolution fails, the dispute is governed by the law applicable at the Operator’s place of operation.
13. Miscellaneous
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. The Operator’s failure to enforce any right or provision is not a waiver. These Terms, together with the policies they incorporate, constitute the entire agreement between you and the Operator regarding the Agent and supersede all prior agreements.
